THE BODY CORPORATE
The Body Corporate
A Body Corporate is a legal entity that is created upon the registration of subdivided land. It has important functions in administering the common property, body corporate assets and undertaking necessary requirements pursuant to the Body Corporate and Community Management Act 1997 (Qld).

The Role of the Committee
The Body Corporate elects a committee to administer the common property and assets for the benefits of all owners and occupiers. GENERAL MEETINGS
General Meetings
There are two types of General Meetings – Annual General Meetings (AGMs) and Extraordinary General Meetings (EGMs). These provide a forum through which the Body Corporate can carry out its functions, including the making of important decisions concerning lot owners and occupiers by means of a voting process.

BODY CORPORATE ELECTIONS
Elections
Body Corporate elections are the mechanism by which the Body Corporate Committee members are elected to fulfil the functions under the Body Corporate and Community Management Act 1997 (Qld). To be elected, the person nominated must be eligible to be a committee member. Webpages on forming a committee provide useful information on the following:

- Nominations and eligibility; and
- Election processes under each regulation module.
In addition to electing committee members, the Commissioner’s Office’s website outlines the legislative process for the ways in which committee members can be removed from office and how those vacancies are filled.
MAINTENANCE & IMPROVEMENTS
Maintenance
The Body Corporate and Community Management Act 1997 (Qld) and associated Regulation Modules place requirements on the Body Corporate and lot owners/occupiers to maintain areas of the scheme for which they are responsible. Maintenance obligations will vary depending on the type of plan under which the scheme is registered, namely a Building Format Plan (former known as a Building Unit Plan or BUP), or a Standard Format Plan (formerly known as a Group Title Plan or GTP). The Commissioner’s office website maintains dedicated and detailed webpages on each of the maintenance elements including:
Improvements
The legislation permits owners to make improvement to common property for the benefit of their lot. Any improvement requires the permission of the body corporate. The webpage titled ‘Improving common property and lots’ outlines information on this topic as well as making improvements to a lot. It is always suggested that you also review your scheme’s by-laws.
FINANCIAL MANAGEMENT
Financial Management
The financial obligations of the Body Corporate and owners are extensive. To assist with ensuring both the Body Corporate and owners individually are informed of their financial obligations, the Commissioner’s Office has information on several different topics including:
- Budgets and funds – including sinking and administrative funds;
- Authority to spend – committee and body corporate spending;
- Lot entitlements – what they are, what they are used for and how to change them; and
- Accounts, audit and contributions – including financial reporting, auditing requirements and owner’s contributions.
BY-LAWS
By-laws
For a Body Corporate to run efficiently, the Body Corporate and Community Management Act 1997 (Qld) provides for the creation, implementation and enforcement of rules, known by-laws, which are adopted by a scheme to regulate a broad range matters associated with, for example, the use and enjoyment of lots or common property, including issues like; pets, behaviour of invitees, appearance of lots and damage to common property.
